Question:
This year, qurbani is on Saturday, and the following Monday is a public holiday. This means that the abattoir (where the animal will be slaughtered) may not slaughter the animal until Tuesday, as many abattoirs are closed on weekends and public holidays. In such a case, will the qurbani be valid, given that Tuesday will be the 13th of Zul Hijjah?
Answer:
بسم الله الرحمن الرحيم
In the Name of Allah, the Most Gracious, the Most Merciful
No, the qurbani will not be valid if the animal is slaughtered on Tuesday, the 13th of Zul Hijjah. The qurbani animal must be slaughtered on the 10th, 11th or 12th of Zul Hijjah for it to be a valid qurbani (Fatawa Hindiya: 5/366, DKI; Khulasatul Fatawa: 4/311).
Furthermore, if the abattoir slaughters the qurbani animal on Tuesday or beyond, it will be compulsory for the person on whose behalf the qurbani was done to give the meat of the animal in sadaqah – it will not be permissible for him to eat it. Moreover, if the market value of the live animal is more than the market value of the meat, then he must also give the difference in sadaqah. For example, he received 15 kg of meat with a market value of $225 (based on $15 per kg). However, the live animal has a market value of $250. This means that there is a $25 difference between the two amounts. Hence, in addition to giving the meat, he must also give $25 in sadaqah.
If he eats any amount of the meat, he must give the market value of the same in sadaqah.*
