والصواب: وعليكم
السلام ورحمة
الله من
تكلم بكلمة
الكفر جاهلا
بأنها كفر ففي
كفره اختلاف
بين الفقهاء
فلا نكفّره
لكن يؤمر بالتوبة
وتجديد
الإيمان
والنكاح
احتياطا. أما
لو نسب أحد
نفسه إلى دين
الكفار بأن
قال مثلا "أنا
هندوسي" أو
"أنا نصراني"
فحكمه – كما
أفتى به الشيخ
المفتي محمد
تقي العثماني حفظه
الله – أنه
يكفر وإن قاله
هازلا ولم
يعرف أنه كفر،
فيجب عليه أن
يتوب ويجدّد
إيمانه
ونكاحه. فيتبيّن
من هذا أنه
يجب على صديقك
أن يتوب
ويجدّد إيمانه
ونكاحه ولا
يعيد قوله
الشنيع أبدا قال

والحاصل أن من
تكلم بكلمة الكفر
هازلا أو
لاعبا كفر عند
الكل ولا
اعتبار
باعتقاده كما
صرح به في

تكلم بها
عامدا عالما
كفر عند الكل
ومن تكلم بها
اختيارا
جاهلا بأنها

Question:
One of my friends said, "I am a Christian". On another occasion he said, "Zina is halal". But he said this jokingly and playfully without intending to commit kufr (disbelief) and leaving Islam. He doesn't believe in what he said and he doesn't know that saying what he said is kufr. Is this kufr in this case? Is it compulsory on him to renew his iman (faith) and nikah (marriage) and to repent?
Jazakallah khairan. Answer:In the Name of Allah, the Most Gracious, the Most Merciful.
Whoever utters a statement of kufr (disbelief) without knowing that it is kufr, then there is difference of opinion among the jurists regarding whether or not he has become a kafir (disbeliever). Hence, we will not deem such a person to be a kafir; however, he will be instructed to repent, to renew his iman (faith) and to renew his nikah (marriage) as a precaution.
However, if a person attributes himself to the religion of the non-Muslims by saying, for example, "I am a Hindu" or "I am a Christian" then the ruling is – as Shaikh Mufti Taqi Usmani (hafizahullah) has ruled – that such a person becomes a kafir. This is even if he uttered the statement jokingly and even if he did not know that it is kufr to say such a thing. Hence, it becomes compulsory on such a person to sincerely repent, to renew his iman and to renew his nikah. From the above it is clear that it is compulsory on your friend to sincerely repent, to renew his iman and to renew his nikah. And he must never again utter those heinous statements.
