One of my friends works in a pharmacy as a pharmacist. Sometimes people come to buy emergency contraception pills. Is it halaal to sell? What should he do when he gets a request? Please advice. Jazakallah Answer: In the Name of Allah, the Most Gracious, the Most Merciful.
In principle, it is permissible to sell something that can be used in both permissible and impermissible ways. If someone uses that thing in an impermissible way, the sin will rest on the user, not the person who sold it to him.
Contraception tablets can be used in both permissible as well as impermissible ways. For example, in certain cases it is permissible for a wife to take contraception tablets in order to prevent pregnancy. Therefore, it is permissible to sell contraception tablets. If someone uses these tablets in an impermissible way, he will be sinful. The person who sold it will not be responsible. في

ويجوز بيع البربط والطبل والمزمار والنرد، وأشباه ذلك
في قول
أبي حنيفة، وعندهما لا يجوز بيع هذه الأشياء. وجه قولهما: إن هذه الأشياء أعدت
للمعصية حتى صارت
بحال لا يستعمل
إلا في
المعصية، فسقطت
ماليتها والتحقت بالعدم، ومن شرط جواز البيع
المالية. ولأبي
حنيفة أن هذه الآلات ليست بمحرمة العين، وكونها آلة المعصية
إنما يوجب سقوط التقوم والمالية
إذا كانت
متعينة للمعصية، وهذه
الأشياء لم تتعين آلة للمعصية؛
لأن الانتفاع بهذه
الأشياء ممكن بوجه حلال بأن
يجعل النرد
سينجات الموازين، والبربط والطبل
والدف ظروف
الأشياء، وإذا لم تكن متعينة
للمعصية لا يسقط تقومها
كالمغنّية فإنه لما
تصور الانتفاع
بعينها بطريق حلال
لا يسقط
تقومها وماليتها
حتى جاز
