Question:
My sister has taken away my wife's jewellery which was kept with her as amanat (as usually most of the jewellery was kept with my mother, but after my mother passed away in 2008, she took control of it). She is not returning the jewellery and says that it is lost and she will return it once she finds it. Do I have to pay zakat on that jewellery?
Answer:In the Name of Allah, the Most Gracious, the Most Merciful.
Because your sister is refusing to return the jewellery, your wife does not have to pay zakat on it until she gets it back. Once she gets it back, she will have to pay zakat on it from then onwards (i.e. she will not have to pay zakat on it for the previous years).
The ruling above is applicable regardless of whether your sister actually has the jewellery (and she is refusing to return it) or she has lost it (as she claims). (See: Shami: 3/218, 341, Darul Ma'rifa) |
