Question:
Assalam aalikum,
My nephew works in Qatar airways as a cabin crew. Serving alcohol on routes where alcohol is allowed is included in his job profile. So now,
1. Will his income generated will be treated as haram?
2. I want to do partnership with him for a business, his share of capital is the income generated from his salary from Qatar airways as a cabin crew in which his job profile include serving alcohol.
Can I do business with him , as I know if one halala of haram is included in any business it makes the whole business haram. So, is his income haram or not.
And guide me with respect of doing business with him.
Jazakalla u khair
Answer:
In the Name of Allah, the Most Gracious, the Most Merciful.
Waalaikumussalam.
1) Serving alcohol is haram. There is stern warning given by the Messenger of Allah (ﷺ) regarding one who serves wine:
It is narrated from Ibn ‘Umar that the Messenger of Allah (ﷺ) said:
“Wine is cursed from ten angles: The wine itself, the one who squeezes (the grapes), the one for whom it is squeezed, the one who sells it, the one who buys it, the one who carries it, the one to whom it is carried, the one who consumes its price, the one who drinks it and the one who pours it.” (Ibn Majah)
It is not permissible to accept a job that comprises of both halal and haram work. Since your nephew’s job comprises of both halal and haram work, the ruling is that his employment will be classified as ijaarah faasidah (corrupt employment). As a result, he will be entitled to receive ajr mithl only for permissible work (such as serving halal food), not impermissible work (such as serving alcohol). Ajr mithl is the amount that is normally paid to a person for doing such work. Any amount more than this will be haram. He must give the haram portion back to his employer. If that is not possible, then he should give it to the poor and needy without the intention of rewards.
2) It will be permissible to enter into a business partnership with him provided that he contributes capital only from the halal portion of his income, not the haram portion.
Alternatively, you could ask your nephew to take a loan and place that money in the capital of the business. From this, all income generated from this business partnership will be halal.
Being his uncle, you should advise your nephew to give up his current job and to look for another job.
