Question:
A cow is being shared for Qurbani. Is it obligatory to weigh all the shares before the people doing Qurbani take their shares? If the shares are not weighed but mutually agreed by all not to weigh, is the Qurbani valid for all people?
Answer: In the Name of Allah, the Most Gracious, the Most Merciful.
When a cow is shared for qurbani, the shares must be distributed evenly by weight. Hence, weighing the shares is compulsory. Even if all the partners agree not to weigh the shares, it will not be permissible to distribute without weighing. However, if all the shares contain some part of the feet or head of the cow then it will be permissible to distribute the shares without weighing.

I recently asked a question on share for Qurbani being weighed. I did not understand the second part of the question where you said we do not need to weigh if head and feet parts are in all shares, thus qurabni will be valid. I a bit conused. Can you please eloborate and clarify. JazakAllah.
Answer:
In the Name of Allah, the Most Gracious, the Most Merciful.
If a cow is shared for Qurbani then it is compulsory to divide the shares according to weight. Dividing the shares by estimation is not permissible, even if all the partners mutually agree to divide the shares by estimation. If the shares are divided by estimation then although the Qurbani will be valid, all those who knew and agreed to dividing the shares by estimation will be sinful; and it is compulsory upon them to do istighfaar and tauba.
The only time it is permissible for the shares to be divided by estimation is when all the shares contain some portion of the feet (trotters) and/or the head and/or the skin of the cow. If you do not understand any part of the answer, please specify what you do not understand. And Allah knows best. Mufti Faizal Riza 7/11/2011 Darul Ifta Australia www.fatwa.org.au |
