Question:

One of my brothers was working in out of india, his company give some reward to distribute in 16  workers and he distributed in 12 workers after that he was infected covide 19 so he was unable to meet rest workers to give  money. This was during covide 19 period, everything was unstable. Now he is in a different country and he has no contact number of those workers and that company also did their work and no one is in contact . So now what should he do with that money? All workers were non muslim.
Kindly guide me under Islamic law.

Answer:

بسم الله الرحمن الرحيم
In the Name of Allah, the Most Gracious, the Most Merciful
It is not clear from the question whether the company closed down or is in operation. If the company is still in operation and can be contacted, then the money should be given back to them. If, on the other hand, the company has closed and cannot be contacted, then your brother should give the money in question in sadaqah to the poor and needy.
 
It should be noted that if at any time in the future the company or any of the workers is located, they will have to be paid their due right.

في البحر الرائق: وعرفها (أي اللقطة) في التتارخانية معزيا إلى المضمرات بأنها مال يوجد ولا يعرف له مالك وليس بمباح اه‍. فخرج ما عرف مالكه فإنه أمانة لا لقطة ولأن حكمها التعريف, وهذا لا يعرف, بل يدفع إلى مالكه (البحر الرائق ج 5 ص 241 دار الإحياء)  

 

في القدوري: اللقطة: أمانة إذا أشهد الملتقط أنه يأخذها ليحفظها ويردها على صاحبها فإن كانت أقل من عشرة دراهم عرفها أياما وإن كانت عشرة فصاعدا عرفها حولا فإن جاء صاحبها وإلا تصدق بها فإن جاء صاحبها فهو بالخيار: إن شاء أمضى الصدقة وإن شاء ضمن الملتقط (مختصر القدوري ص 516-517 ط. البشرى)
